By using What's Up Tonight? (the "app"), you agree to these terms. If you don't agree, please don't use the app.
Who can use it
You must be at least 16 to use the app. You must be 18 or older to post or join pickup games and to use listings for bars, nightlife, or other adults-only venues. Some events have their own age rules; the venue's rules apply.
What the app is
The app gathers publicly listed events, places, and activities from venues, calendars, ticket sellers, open data, and community map data, and lets people post pickup games. We work hard to keep it accurate, but listings come from third parties and can change or be wrong. Always confirm times, prices, and availability with the venue or seller before you go.
Tickets and third-party sites
Tickets are sold by the venues and ticket sellers we link to, not by us. Your purchase is governed by their terms. Some links may be affiliate links, which pay us a small commission at no cost to you.
Pickup games and what you post
- Pickup games are organized by users, not by us. We don't vet participants or venues. You are responsible for your own safety and conduct: meet in public places, follow the rules of the facility, and use good judgment. Don't post games at places where you don't have permission to play.
- When you post a game, a title, notes, a name, a profile photo, a plan you share, or feedback, you give us a worldwide, royalty-free license to show it in the app and in shared links for as long as it's posted (shared plans expire after 60 days), and you confirm you have the right to post it. Don't upload a photo of someone else without their permission.
- If you sign up for the Thursday picks email, you're asking us to send one email a week. Every email has a link that takes you off the list in one tap.
- Posts must follow these Terms. We have zero tolerance for objectionable content and abusive users. We don't allow abusive, hateful or unsafe posts, and we remove them within 24 hours.
- That means no harassment, threats, slurs or hate toward any person or group; nothing sexual, violent or illegal; no spam, scams or fake games; nothing that puts people in danger; and no one else's personal information (phone numbers, addresses, photos) without their permission.
- Posts are checked for offensive words before they go up, and posts that contain them are rejected.
- We may remove any game, entry, plan or other content at any time, and we suspend or remove people who break these rules.
Reporting and blocking
- Report a post. Every pickup game and shared plan has a Report button. Pick a reason (spam, offensive, unsafe, or something else) and add details if you like. The person you report isn't told who reported them.
- Hide a host. On a pickup game, tap Hide games from this host and you won't see their games again. They aren't told.
- What we do. We review every report and remove content that breaks these Terms within 24 hours, and we suspend or remove the people who posted it. Games that several people report are hidden from the app while we look at them.
- To report a listing, a venue, or anything else, use Feedback in the app or email info@whatsuptonightapp.com. If someone is in danger, call 911 first.
Your account and conduct
- You're responsible for activity under your sign-in. Keep your password secure and don't share your account.
- Don't use the app to harass others, post false or misleading games, scrape or copy our data at scale, interfere with the service, or break the law.
Content and rights
Event names, descriptions, and images belong to their respective venues and rights holders and are shown to promote their events, with a link back to the source. Venue data is © OpenStreetMap contributors (ODbL). Show data adapted from TVmaze is CC BY-SA. If you hold rights to a listing or image and want it changed or removed, email info@whatsuptonightapp.com with the link and what you'd like done; we act on valid requests promptly.
Copyright notices (DMCA). Send notices of claimed infringement to our copyright agent at info@whatsuptonightapp.com. Include the work, the location in the app, your contact details, a good-faith statement, and your signature.
No warranties; limitation of liability
The app is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for anything that happens at an event, venue, or game you find through the app. Our total liability for any claim is limited to the amount you paid us, which is currently nothing.
Changes and termination
We may change the app or these terms at any time; continued use after a change means you accept it. We may end or limit access to the app for anyone, at any time.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
